Important Preamble — Please Read Carefully
A. These Terms and Conditions incorporate provisions which allocate risk and liability to you, and which limit or exclude the duties, obligations, liabilities and legal responsibilities of Yomo towards you and third parties. These Terms and Conditions restrict the rights and remedies available to you against Yomo and impose various risks, obligations and responsibilities upon you. In certain circumstances, you may be required to incur additional costs or expenses, and Yomo may acquire claims and other enforceable rights against you.
B. Where these Terms and Conditions, or any products or services supplied under them, fall within the scope of the Consumer Protection Act, 2008 (the "CPA"), nothing in these Terms is intended to override or conflict with the CPA. All provisions must be interpreted as being subject to the CPA, to the extent necessary, to ensure full compliance with its requirements.
C. Please read these Terms and Conditions carefully. By electing to participate in this Promotion, you will be deemed to have accepted, and to be bound by, these Terms and Conditions in their entirety. Should you not agree to be bound by these Terms and Conditions, you are expressly required to refrain from participating in this Promotion.
D. Please note that these Terms and Conditions are subject to your Subscriber Contract Terms and Conditions.
- "On-net minutes" — minute allocations used by the subscriber to call other subscribers on the Cell C network.
- "Off-net minutes" — minute allocations used by the subscriber to call other subscribers outside of the Cell C network.
- "Anytime Data" — data that can be used by the subscriber anytime during the day or night.
- "Night Data" — data that can be used by the subscriber during 23:59 until 5:00.
- "A Business Customer" — a legal entity registered with CIPC including but not limited to a Sole Proprietor, Close Corporation, Private Company.
- "Corporate Consumers" — customers who purchase in their personal capacity and associate themselves with a Business Customer through employment.
- "Qualifying Customer" / "Customer" — individuals part of the NYS programme.
Yomo introduces a range of Yomo bundles available to Qualifying Customers as detailed in these Terms and Conditions.
- The Yomo bundles provide a range of voice, data and SMS prepaid options.
- All bundles have a set expiry limit.
- TopUp bundles shall be depleted as "earliest expiry first".
- Airtime can be used to purchase bundles.
- The data value is depleted at 50c.
- The voice value is depleted at R1 per minute minimum bill increments.
- The voice value cannot be used for international roaming or international calling.
- The voice and data bundle cannot be transferred or shared.
- There will be no carry-over of unused voice, data or SMS upon migrations or SIM swaps.
- Once the voice, data and SMS has been depleted, out of bundle usage shall incur from the subscriber's airtime.
Note: Depletion notification at 90% will be sent to customers.
All value-added services depend on the discretion of Yomo and may be withdrawn at any time with notice.

General Terms and Conditions
- Qualifying Customers will be able to view their balances on the Yomo App and USSD.
- Qualifying Customers may cancel their packages by contacting the Yomo call centres or via the Yomo App and USSD.

Promotional Terms and Conditions
- The Promotional pricing is available as and when Yomo runs promotions during a specific duration.
- A Customer may purchase the package at any time between the start date and end date.
- Yomo may, in its sole and absolute discretion, amend the duration of the Promotion Period to a shorter or longer period, or withdraw the Promotion in its entirety, with notice to you.
In terms of the Amended Regulation of Interception of Communications and Provision of Communication-related Information Act 70 of 2002 ("RICA"), the Qualifying Customer is obliged to provide proof of their full names, surname, Identity Document number and residential address to a RICA officer when purchasing a SIM card. This is necessary to activate them as a customer on the Yomo network.
Yomo is obliged by law not to activate the Qualifying Customer's SIM card on the Yomo network if they have not complied with the RICA registration requirements.
By law, if a SIM card is lost, stolen or damaged, the Qualifying Customer is required to immediately notify the South African Police Services in writing and immediately notify Yomo and request the SIM card to be suspended.
If the Qualifying Customer wishes to transfer/sell their SIM card to another person (other than a family member), they are required to contact their Service Provider to report such a transfer to Yomo. Before the new holder of the SIM card can use it, they must provide proof of their details to an approved Yomo RICA officer. Once compliant, Yomo will reactivate the SIM card.
Important: The Qualifying Customer is not allowed to change ownership to a third party as this Promotion is not transferable. Failure by any person holding/using a SIM card to comply with RICA is an offence.

Mobile Number Portability (MNP)
This service enables you to transfer to an alternative mobile network operator while retaining your existing cellular number. A Caller Line Identity ("CLI") validation will be required to verify that the number to be ported is lawfully in your possession.
Please note: Upon porting, any unused airtime, data bundles, credits and stored voicemail messages will be forfeited and will not be recoverable. The porting process is subject to the applicable MNP regulations and relevant terms and conditions.
The SIM swap service allows you to keep your old preferred Yomo MSISDN, subject to certain conditions. After registering your details in compliance with RICA, you will be able to initiate the SIM swap process.
- A SIM swap is allowed if you are RICA compliant, the old MSISDN is active, available on the Yomo network, has not been recycled, and is not in use by another Customer.
- A SIM swap will only be allowed for one MSISDN number at any given time.
- If the new MSISDN has been active/used to make calls for more than 24 hours, a SIM swap cannot be performed.
- Customers will be able to keep their airtime balance, credits or subscriptions from their old SIM card once a SIM swap is performed.

Limitation of Liability
Subject always to the provisions of the Consumer Protection Act, 2008 ("CPA"), and to the extent permitted by any other applicable law, Yomo shall not be liable to you or to any third party for any loss, harm, damages (whether direct, indirect, consequential, or otherwise) suffered in connection with:
- The non-supply or non-delivery of any device or SIM card on the required date or at the required time.
- Any interruption, suspension, or termination of the Yomo network services, for any reason whatsoever.
- A failure by Yomo to suspend the provision of its network services to you after you have specifically requested such suspension.
- Any loss or damage arising from an act or omission of Yomo, its employees, or its agents, whether negligent or otherwise.
- Any use by you of a device supplied by Yomo in connection with the services.
Note: The provisions above shall not operate to limit or exclude any statutory warranties, rights, or obligations that are implied into this service agreement by the CPA where such limitation or exclusion is not permissible in law.
Yomo also makes available a subscriber portal within its mobile application known as the YomoVerse. Access is conditional upon the Customer maintaining an active subscription and paying the prescribed monthly fee. Failure to pay shall automatically suspend the Customer's access until payment is received.
No ownership of intellectual property in the YomoVerse or other software passes to the Customer. The Customer is granted only a limited, non-exclusive, non-transferable right to use the portal for as long as the subscription remains active.
12.3.1 Lawful Use
The Qualifying Customer agrees to utilise the Application solely for lawful purposes and in strict compliance with these Terms, any policies published by Yomo, and all applicable legislation including the Electronic Communications and Transactions Act, 2002 ("ECTA").
12.3.2 Prohibited Conduct
- Upload, post, or transmit any content which is unlawful, defamatory, obscene, offensive, infringing, or otherwise objectionable.
- Harass, abuse, stalk, threaten, or otherwise violate the legal rights of any other person.
- Copy, reproduce, adapt, decompile, reverse engineer, or attempt to derive the source code of the Application.
- Circumvent, disable, or interfere with any security-related features of the Application.
- Engage in any activity which imposes an unreasonable or disproportionately large load on Yomo's infrastructure.
- Employ any automated process such as robots, spiders, or crawlers without Yomo's prior written consent.
12.4 Customer Responsibility
The Customer shall be solely responsible for their conduct and use of the Application and for ensuring that such use does not infringe the rights of, or cause harm to, any third party.

Security and Digital Platform Rules
13.1 Company Safeguards
Yomo shall implement and maintain appropriate, reasonable technical and organisational security measures to protect the integrity, confidentiality, and availability of the Application and any data processed thereby, including encryption, access control protocols, firewalls, and security monitoring systems.
13.2 Customer Obligations
- Maintain the confidentiality of all Customer names, passwords, and access credentials.
- Refrain from permitting any third party to access or use the Customer's account.
- Ensure that all devices used to access the Application are secured by up-to-date anti-virus software and operating system updates.
- Notify Yomo immediately upon becoming aware of any unauthorised access to, or use of, the Customer's account, or any other security incident.
13.3 Internet Risks
The Customer acknowledges that the transmission of information over the Internet may be susceptible to unlawful monitoring, interception, or access by third parties. Whilst Yomo shall take reasonable precautions to secure the Application, it does not warrant that the Application shall be immune from all cyber threats, attacks, or unauthorised access. The Customer accordingly makes use of the Application at their own risk.
13.4 Enforcement
Yomo reserves the right, without prior notice, to suspend or terminate the Qualifying Customer's access to the Application where Yomo reasonably suspects any breach of this clause or any security compromise.
14
Intellectual Property Rights
14.1 Ownership
All intellectual property rights, including copyright, trademarks, trade names, logos, designs, software, source code, know-how, databases, and any derivative works thereof, vest in Yomo or its licensors and shall remain their exclusive property.
14.2 Limited Licence
Subject to strict compliance with these Terms, Yomo grants the Customer a limited, non-exclusive, non-transferable, revocable licence to install and use the Application solely for the Customer's personal and lawful purposes.
14.3 Restrictions
- Copy, reproduce, modify, adapt, distribute, or create derivative works based on the Application.
- Sublicense, assign, sell, lease, rent, or otherwise commercially exploit the Application.
- Remove, obscure, or alter any proprietary notices or legends appearing on the Application.
14.4 Legal Remedies: Any unauthorised use of Yomo's intellectual property may result in civil action and/or criminal prosecution under applicable South African law, including the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993.

Privacy and Data Protection
Yomo processes personal information in accordance with the Protection of Personal Information Act, 2013 ("POPIA") and any other applicable legislation.
15.2 Collection of Personal Information
Yomo may collect personal information, including the Customer's identity particulars, contact details, device information, usage data, and location data where the functionality of the Application so requires.
15.3 Purpose of Processing
- Enabling the Customer's access to, and use of, the Application.
- Verifying the identity of the Customer and preventing fraudulent activity.
- Analysing, improving, and personalising the functionality of the Application.
- Complying with legal obligations, including obligations imposed under RICA where applicable.
15.5 Disclosure of Information
Yomo may disclose personal information to its employees, affiliates, and contractors; to third-party service providers subject to confidentiality undertakings; and where required to do so by law, regulation, or order of a competent authority.
15.6 Customer Rights under POPIA
- Request access to personal information held by Yomo.
- Request the correction, deletion, or destruction of inaccurate, irrelevant, or unlawfully obtained personal information.
- Object to the processing of personal information for purposes of direct marketing.
- Lodge a complaint with the Information Regulator of South Africa.
15.7 Retention: Personal information shall be retained only for as long as is necessary to achieve the purposes set out herein, or as required by law. Thereafter, such records shall be securely destroyed or de-identified.
- Yomo reserves the right to suspend services due to non-payment within 7 days of any amounts being due.
- Upon suspension of services, Yomo reserves the right to recover all costs associated thereto.
- The Customer will be able to access services only within the Republic of South Africa and in an area covered by the Yomo network.
- Inactivity: Your number will be deactivated and recycled after 90 (ninety) days of inactivity on the network.
- The Customer will be solely responsible for all products and services from delivery of the Promotion to them. In the event of theft or loss of their device and/or SIM card, such items must be replaced at the customer's own cost. Customers are obliged to report such loss or theft to the South African Police Services immediately, and to request Yomo to suspend such SIM Card.
- Yomo is not responsible for a service being interrupted and/or failing for any reason or for any interruption in the network services.

Modification of Terms and Conditions
Yomo reserves the right, at any time, to change, vary, amend, or replace these Terms and Conditions and any rules relating to this Offer, its promotions, its products, and services at its discretion, with notice to you.
Any changes to rules and/or Terms and Conditions are effective from the date that they are published on the website or elsewhere in any media.
Yomo reserves the right at any time to modify, suspend or discontinue the services, with notice, without liability to you or any third party. Yomo will under no circumstance be liable to you for any error, delay, failure, or non-availability of the service, and you indemnify Yomo against any damage or loss you may sustain because of possession and/or use of the SIM card, Yomo network services, or any error, delay, failure or non-availability of the service.
Yomo reserves the right from time to time to vary the charges of these services as may be deemed necessary in its discretion.

Current Promotions
1. Buy 1, Get 1 Free — 1 June 2026 to 30 November 2026
This promotion applies to specific bundles available on the Yomo recharge platforms. Please make reference to the info reels on the mobile app and various recharge mechanisms.
2. 50% Back on Airtime — 1 August 2026 to 31 January 2027
This promotion applies to airtime purchased during the promotional period. The following depletion rates apply during the promotional period:
- Data: R1.00/mb
- Voice: R1.50/min
- SMS: R0.20
3. Non-Transferability & Commercial Use
The benefits of this Promotional Package are strictly personal to the end-user and may not be transferred, shared, or re-sold to any third party.
4. Modification of Promotional Terms
Yomo reserves the right, at any time, to change, vary, amend, or replace these promotional Terms and Conditions at its discretion, with notice to you. Any changes are effective from the date they are published on the website or elsewhere in any media.
Indemnity: Yomo will under no circumstance be liable to you for any error, delay, failure, or non-availability of the service, and you indemnify Yomo against any damage or loss you may sustain because of possession and/or use of the SIM card, Yomo network services, or any error, delay, failure or non-availability of the service.
